CHALLENGING CIVIL PENALTIES

A civil penalty e.g. fines can be issued by the Home Office if they discover that an employer has been employing persons illegally in the UK. Employers who have received such a civil penalty can object to the Home Office or appeal to a County Court. If you have been issued with a Referral Notice or a Civil Penalty Notice, A. Vincent Solicitors is able to offer advice and assistance on how to respond to such notices. 

SPONSOR LICENCE APPLICATION

Employers intending to employ foreign workers would have to go through a Sponsorship License application and there are certain requirements that the employer would have to meet before they can make an application. You can either make a Tier 5 or Tier 2 Sponsorship License application.

SPONSOR LICENCE MANAGEMENT

To continue employing foreign workers legally in the UK, you will have to renew your Sponsor Licence within 3 months of the expiry of your current Sponsor Licence. To do so, the Sponsor Management System must be used. This system is also used to issue Certificates of Sponsorship to Tier 2 and Tier 5 employees.

CHALLENGING SPONSOR LICENCE SUSPENSION/ REVOCATION

All Tier 2 and Tier 5 Sponsors should expect at least one compliance visit from the Home Office throughout the duration of their Sponsor Licence. If the Home Office believes that the sponsor is not complying with its sponsor duties, it may suspend the Sponsor Licence with a view of permanently revoking it. Before the licence is revoked, the sponsor is given an opportunity to make representations and a timescale of 20 working days is usually given to do so.
